Although environmental damage assessments have been mentioned in several court cases, so far there have been no cases that have resulted in recovery or compensation activities for the affected communities. Among the cases that grant environmental restoration are cases of corruption in the use of timber for forest conservation into palm oil in East Kalimantan, corruption cases in industrial forest plantation permits in Riau, corruption cases in mining business permits in Central Sulawesi, forest fires in South Sumatra, fire cases forest in Aceh, and the case of forest fires in Riau.

However, the problem is that until now there is no mechanism for the management and use of compensation from the valuation for environmental restoration through the law enforcement process. Not only that, the process of calculating environmental losses has not been formulated in a solid manner, and there is not even a calculation and measure of recovery for the damage itself, including the impact on the affected community.

To answer the above problems, the Auriga Nusantara Foundation, the Faculty of Law, Andalas University and GreenPeace Indonesia invite researchers from academics, law enforcement, judicial institutions, ministries/state institutions, non-governmental organizations, journalists, and students to submit papers that will be published. presented in a national symposium with the title “Economic valuation policy for environmental restoration in policy and post-judicial decisions” on December 15, 2021.

Meski valuasi kerusakan lingkungan telah disebut dalam beberapa kasus pengadilan, namun hingga saat ini belum ada perkara yang berujung pada kegiatan pemulihan atau kompensasi terhadap masyarakat yang terdampak. Diantara kasus-kasus yang mengabulkan pemulihan lingkungan diantaranya kasus korupsi izin pemanfaatan kayu untuk konservasi hutan menjadi sawit di Kalimantan Timur, Kasus korupsi perijinan hutanan tanaman industri di Riau, kasus korupsi izin usaha pertambangan di Sulawesi Tengah, kasus kebakaran hutan di Sumatera Selatan, kasus kebakaran hutan di Aceh, dan kasus kebakaran hutan di Riau.

Namun persoalannya adalah hingga saat ini ternyata belum ada mekanisme pengelolaan dan penggunaan ganti rugi dari valuasi untuk pemulihan lingkungan melalui proses penegakan hukum. Tak hanya itu, proses penghitungan kerugian lingkungan hiduppun belum dirumuskan secara solid, bahkan belum tersedia penghitungan dan ukuran pemulihan terhadap kerusakan itu sendiri, termasuk dampak terhadap masyarakat terdampak.

Untuk menjawab persoalan di atas Yayasan Auriga Nusantara, Fakultas Hukum Universitas Andalas dan GreenPeace Indonesia mengundang peneliti-peneliti baik yang berasal dari akademisi, penegak hukum, lembaga peradilan, kementerian/lembaga negara, lembaga swadaya masyarakat, jurnalis, maupun mahasiswa untuk mengirimkan makalah yang akan dipaparkan dalam simposium nasional dengan judul “Kebijakan valuasi ekonomi untuk pemulihan lingkungan hidup dalam kebijakan dan pasca putusan peradilan” pada tanggal 15 Desember 2021.

December 17, 2020 – Responsible Mining Index (RMI) is an instrument that adhere to principle that minerals and metals mining should benefit the economies, improve people’s livelihood, and respect the environment of producing countries; while also allowing mining companies gaining profits in a fair and viable way.

This instrument was initiated by Responsible Mining Foundation, a Switzerland-based independent research organization advocating for a more responsible mining practices through assessment instrument. Currently, Auriga Nusantara is adopting RMI and is conducting assessment on Indonesian mining corporations.

As a starting point, Auriga Nusantara held a virtual focus group discussion on Thursday, December 17, 2020. The main goal of the event was to disseminating what is and how RMI works, as well as obtaining inputs from stakeholders including the government, mining companies represented by mining association, and civil society organizations that work on extractive industry issues.

RMI dibangun oleh Responsible Mining Foundation, sebuah organisasi masyarakat sipil yang berbasis di Swiss yang berusaha untuk mengadvokasi pertambangan yang lebih bertanggung jawab melalui instrument assessment.

Auriga Nusantara mengadakan diskusi terfokus pada Kamis, 17 Desember 2020 melalui virtual untuk mensosialisasikan apa dan bagaimana instrument ini bekerja dan meminta masukkan dari stakeholder yang terdiri dari pemerintah, perusahaan tambang yang diwakili oleh asosiasi dan organisasi masyarakat sipil yang bekerja pada isu industri ekstraktif.

AURIGA -  The latest condition of forest management policy faced by the Papuan indigenous peoples. This report focuses on the Customary Forest Concession License.
